Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Attentia platform, including our websites, ADHD tests, research prototypes, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Service. Please read them carefully and review them periodically, as they may be updated from time to time.

These Terms are supplemented by our Privacy Policy and Cookie Policy, which explain how we process personal data and use cookies. Our Imprint provides legal disclosure information.

1. Eligibility

The Service is intended primarily for adults and for use in professional or supervised settings. By using the Service, you confirm that:

  • you are at least 18 years old; or
  • you are using the Service under the supervision of a parent, guardian or qualified professional, in accordance with applicable law; and
  • you have the legal capacity to enter into these Terms.

If you use the Service on behalf of an organisation (for example, a clinic, hospital, university or company), you confirm that you are authorised to bind that organisation to these Terms.

2. Nature of the Service – no medical advice

Attentia provides digital tools, ADHD-related tests and research prototypes that can be used to explore patterns related to attention and related traits. Unless explicitly stated otherwise in writing:

  • the Service is not a certified medical device;
  • the Service does not provide a diagnosis, treatment, or cure for any disease or medical condition; and
  • results and insights are intended for research, exploration and self-reflection, and must not be used as a substitute for professional medical advice.

You should always consult a qualified healthcare professional for questions about diagnosis, treatment or medication. Never disregard professional medical advice or delay seeking it because of information obtained via the Service.

3. Accounts and security

You may need an account to use parts of the Service. You are responsible for:

  • providing accurate and up-to-date information when registering;
  • keeping your login credentials confidential; and
  • all activities that occur under your account, unless you promptly notify us of suspected misuse.

We reserve the right to suspend or terminate accounts that are used in violation of these Terms or in a way that threatens the security, stability or integrity of the Service.

If you become aware of any unauthorised use of your account or any other breach of security, you must notify us without undue delay.

4. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. In particular, you must not:

  • use the Service in any way that violates applicable law or the rights of others;
  • attempt to gain unauthorised access to the Service, user accounts, or our underlying systems;
  • interfere with or disrupt the integrity or performance of the Service, for example by introducing malware, automated scraping, or excessive load;
  • reverse engineer, decompile or attempt to extract the source code of any part of the Service, except where such restrictions are prohibited by law;
  • use the Service to train competing models or services without our prior written consent;
  • misrepresent your identity or affiliation, or use the Service to harm, harass or deceive other people.

We may investigate suspected violations and, where appropriate, involve law enforcement or other authorities.

5. Data & privacy

The processing of personal data in connection with the Service is described in our Privacy Policy and Cookie Policy. This includes information about:

  • which data we collect and for what purposes;
  • the legal bases under GDPR and other applicable laws;
  • how we use third-party processors such as Supabase; and
  • your rights, including access, rectification, deletion and objection.

By using the Service, you acknowledge that your personal data may be processed as described in the Privacy Policy. In some cases, especially for research or health-related data, we may ask for your explicit consent.

6. Intellectual property

The Service and all related content, including but not limited to software, interfaces, models, text, graphics, logos and trademarks, are owned by us or our licensors and are protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose, subject to these Terms. You may not copy, modify, distribute, sell or lease any part of the Service unless you have our prior written permission or such use is permitted by mandatory law.

If you provide feedback or suggestions, we may use them freely without obligation to you.

7. Availability and changes to the Service

We aim to provide a stable and secure Service, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, technical issues or factors beyond our control.

We may modify, suspend or discontinue parts of the Service at any time, for example to improve functionality, address security issues, or comply with legal requirements. Where possible, we will try to notify you of material changes in advance.

We are not obliged to maintain any particular feature or component of the Service, or to provide backwards compatibility.

8. Liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the extent permitted by law, our liability for damages arising from or in connection with the use of the Service is limited to the amount you have paid (if any) for access to the Service in the twelve (12) months preceding the event giving rise to the claim.

We do not exclude or limit liability where it would be unlawful to do so, for example for intentional misconduct, gross negligence, or injury to life, body or health.

9. Third party services and links

The Service may contain links to third-party websites or integrate third-party services (such as Supabase, analytics providers or video tools). We do not control and are not responsible for the content, security or privacy practices of these third parties.

Your use of third-party services is subject to their respective terms and privacy policies. We encourage you to review those documents carefully.

10. Governing law and venue

These Terms and any disputes arising out of or in connection with them are governed by the laws of Austria, excluding its conflict-of-law rules.

The courts of Vienna, Austria shall have exclusive jurisdiction for all disputes arising out of or in connection with these Terms, unless mandatory consumer protection rules designate another venue.

11. Changes to these Terms and contact

We may update these Terms from time to time, for example to reflect changes in the Service or legal requirements. The "Last updated" date at the top indicates the current version. If changes materially affect your rights, we will take reasonable steps to inform you (for example, via the Service or by email, where appropriate).
